| Résumé : |
The purpose of this book is to help forward the eventual establishment of a comprehensive and satisfactory law of the sea in particular relation to fisheries. Seven years of research and reflection have gone into its compilation. The author, Dr. Albert W Koers, presently associated with the Institute of International law of the University of Utrecht, Netherlands, graduated at that university, and thereafter was engaged successively at Harvard law school, the Rhode Island university law of the sea institute and the Woodrow Wilson international center for scholars, Washington PC. This last post led to his being specially commissioned to write this work.
It is a scholarly presentation in simple lucid sentences of a work long needed in a world now facing increasingly complex issues and the strains of conflicting interests. After stating the problems in biological, technological, economic and political terms - all of which present distinct challenges to legal arrangements - the author gives the facts about the existing international fisheries organizations. About twenty major bodies and nine subsidiary ones (the latter under the direct stimulus of the food and agriculture organization) have been created through international co-operation to cope with particular problems. The book then analyses at length the structure, functions and powers of these organizations, an analysis which clearly points out that their effectiveness is limited and their failures many. The author makes numerous suggestions for improvements. |
